1. Acceptance of Terms
These Terms of Service (the “Terms”) govern your access to and use of the VerifyFashion mobile application, website, and related services (collectively, the “Service”). By downloading, installing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not access or use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your state of residence, you may only use the Service with the consent of a parent or legal guardian who accepts these Terms on your behalf. The Service is primarily intended for users located in the United States. By using the Service, you represent that you comply with all laws and regulations applicable to you, including the laws of the State of Florida.
3. Changes to the Service or Terms
We may update these Terms from time to time to reflect changes in our Service, business, or applicable law. Material changes will be communicated through the app, our website, or by email. The updated Terms will be effective upon posting unless otherwise stated. Your continued use after the effective date constitutes acceptance of the revised Terms.
4. Accounts and Security
You may need an account to access certain features. You agree to provide accurate, current, and complete information and to update your information as needed. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. 5. License to Use the Service
Subject to these Terms, Two Doves Harvest grants you a limited, non-exclusive, non-transferable, revocable license to download and use the VerifyFashion app for your personal, non-commercial use on an iOS device that you own or control, in accordance with the usage rules set forth in the Apple App Store Terms of Service.
Two Doves Harvest retains all right, title, and interest in the Service, including all content, trademarks, and technology. Except as expressly provided, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the Service or any portion thereof.
6. User Content
The Service may allow you to upload images, descriptions, or other content (collectively, “User Content”). You retain ownership of your User Content but grant Two Doves Harvest a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, display, and use your User Content solely to provide and improve the Service. You are responsible for ensuring that your User Content does not violate any laws, intellectual property rights, or privacy rights.
You represent that you have the rights necessary to upload User Content to the Service and that the content does not contain personal information of third parties without their consent. You understand that artificial intelligence outputs are generated based on the User Content you provide and may be inaccurate or incomplete.
7. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any local, state (including Florida law), federal, or international regulation;
- Upload User Content that infringes or misappropriates the intellectual property or privacy rights of others;
- Upload malware, attempt to gain unauthorized access to the Service, or interfere with its operation;
- Reverse engineer, decompile, or otherwise attempt to derive source code except as permitted by law;
- Use automated scripts to collect information or otherwise interact with the Service;
- Misrepresent or falsify any information you provide to us.
8. App Store Requirements
These Terms are between you and Two Doves Harvest, not Apple Inc. Apple is not responsible for the Service or its content. Apple has no obligation to furnish any maintenance or support services for the Service. In the event of a failure of the Service to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the Service. You acknowledge that Apple is a third-party beneficiary to these Terms and may enforce them against you.
9. Fees and Payments
Certain features of the Service may require payment. Prices will be displayed within the app and are subject to change. If you purchase a subscription or consumable credit through the Apple App Store, billing and cancellation terms are governed by Apple. All sales are final except where required by law. Taxes will be calculated based on the billing address you provide to Apple.
10. AI Output, Disclaimers, and No Professional Advice
The Service uses machine learning models to analyze fashion items and provide suggested identifications, authenticity confidence scores, value estimates, and similar information. AI outputs are informational only, may be inaccurate, and do not constitute professional, appraisal, or authentication advice. You assume all risk for decisions made in reliance on the Service. Always consult qualified professionals for buying, selling, insuring, or authenticating items.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TWO DOVES HARVEST, ITS AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, EMPLOYEES, OR AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
12. Indemnification
You agree to indemnify, defend, and hold harmless Two Doves Harvest and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
13. Florida Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. You agree that any dispute, action, or proceeding arising out of or relating to the Service or these Terms will be brought exclusively in the state or federal courts located in Orange County, Florida, and you consent to the jurisdiction of those courts. If any provision is held unenforceable, it will be modified to the extent necessary to render it enforceable, and the remaining provisions will remain in full effect.
14. Compliance with Florida and U.S. Law
You agree to comply with the Florida Deceptive and Unfair Trade Practices Act, Chapter 501, Part II, Florida Statutes, and all other consumer protection, privacy, and intellectual property laws that apply to your use of the Service. The Service is not intended for use in any jurisdiction where its use would violate applicable law.
15. Termination
We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your license to use the Service will cease immediately. Sections that by their nature should survive termination will remain in effect, including Sections 6, 10, 11, 12, 13, and 17.
16. Export Compliance
You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. You agree to comply with all U.S. export and re-export restrictions applicable to the Service.
